O presente artigo pretende aplicar para a interpretação do filme_ Os Irmãos Cara de Pau_ (_The Blues Brothers_, 1980), de John Landis, o que o crítico literário canadense Northrop Frye afirmou em relação à Bíblia como sendo o “grande código” da arte. A premissa básica do artigo é que o filme de Landis segue a estrutura básica de três narrativas bíblicas (Êxodo 3.1-10, Isaías 6.1-8 e Atos dos Apóstolos 9.1-15) nas quais há uma manifestação do sagrado, seguida de um comissionamento (...) para uma missão. O artigo apresenta algumas considerações sobre a relação entre cinema e Bíblia, seguidas de uma apresentação do filme propriamente. Depois disso, comenta-se sobre três narrativas bíblicas de chamado e comissionamento, que entendemos fornecem a linha narrativa seguida pelo filme. Como base teórica, o artigo trabalhou principalmente com a ideia de sagrado selvagem, de Roger Bastide, e do elemento indizível do sagrado, a partir de Rudolf Otto. (shrink)

Interfaith dialogue has been a border issue in theology at least in the last five decades of the last century. Different theoretical possibilities of approaches to such a question have been raised, e.g., exclusivism, inclusivism and pluralism. Therefore, there are remarkable contributions to this from a Catholic perspective, by Westerner theologians: Europeans, Americans, Brazilians and by Asians alike. Technical literature in Brazil has its focus mainly on this Catholic contribution. As a consequence, not much about the Protestant understanding of the (...) theme has been said. During decades Brazilian Pentecostal Evangelicals avoided at any cost to involve in politics, as it was considered dirty and unworthy of Christians. However, for some years now, it is great the involvment of Pentecostal leaders in politics. Many candidates to public positions present themselves as “Pastor So and So” as a way to call the attention of Evangelical voters. One of the first Brazilian Pentecostal leaders to speak openly about politics was Manoel de Mello e Silva, known as Manoel de (...) Mello, who was founder of the Evangelical Pentecostal Church O Brasil para Cristo – Brazil for Christ. This article intends to present critically the historical context of the organization of BfC and the political involvement of Manoel de Mello, with emphasis on his concerning regarding Human Rights, considering it is still rare the academical research on the model of Pentecostalism in Brazil of which BfC is representative, and it is even lesser the research of this Pentecostal branch in the perspective of its political speech. The growth of urban violence in Brazil, as in other countries, has led citizens to demand more severe and punitive measures to solve the problem of juvenile crime. One motion submitted to the Brazilian parliament, for instance, proposes to reduce the age of penal majority from 18 to 16 years. Our hypothesis is that popular opinions about this proposal are largely constrained by construal levels and psychological distance. Accordingly, we expect that the knowledge and proximity to the circumstances associated with (...) juvenile transgression will influence opinions about the proposal. To test this hypothesis, we evaluated how opinion against or for the proposal can be explained by psychological distance and moral development theory. We studied two samples, composed of people who do not have a deep experience with the subject and workers from a juvenile justice court. After collecting socio-demographic information from the subjects and their answer to moral dilemmas, the data was subjected to a multivariate analysis by multimodal logistic regression for socio-demographic characteristics, Kohlberg moral stages, and opinion on the reduction of APM as dependent variables. Our findings suggest that 1) opinion about the APM depends on psychological distance and 2) socioeconomic variables may influence the average construal level of adolescent transgressors in the public’s perspective. O artigo apresenta uma discussão acerca da percepção do imaginário da cultura africana e afro-brasileira e da construção da identidade étnico-racial no enredo escolar. A investigação foi realizada a fim de: 1- analisar os tipos de suportes e referenciais culturais que a escola fornece para a construção da identidade étnico-racial; 2- identificar as consequências do tipo de representação do negro construída e percebida na escola para o desenvolvimento da identidade étnico-racial dos alunos do Ensino Fundamental I. Para tanto, utilizou-se a (...) abordagem de pesquisa qualitativa, empregando o uso da modalidade pesquisa-participante e análise documental do Plano Municipal de Educação de Corrente-PI, município onde a pesquisa foi desenvolvida, Parâmetros Curriculares Nacionais e a Base Nacional Comum Curricular. A participação direta ocorreu por meio da realização de uma oficina de leitura realizada em uma turma do 2º ano do ensino fundamental, contemplando a literatura fornecida pelo PNBE, que versa sobre a construção da identidade étnico-racial. Diante da problemática e da dificuldade de implementação das leis que regem o ensino da temática, a pesquisa torna-se relevante, pois, longe de se esgotar a uma conclusão final, este estudo reforça a necessidade do constante debate e a busca por efetivação de práticas educativas que formem cidadãos emancipados e forneçam subsídios para os negros se autoafirmarem e para a valorização da cultura de matriz africana. Assim como a necessidade da busca por adequação, implementação, monitoramento e avaliação constante das leis que regem o ensino de história e cultura africana e afro-brasileira. (shrink)

Wearing facial masks became a common practice worldwide during the COVID-19 pandemic. This study investigated (1) whether facial masks that cover adult faces affect 4- to 6-year-old children’s recognition of emotions in those faces and (2) whether the duration of children’s exposure to masks is associated with emotion recognition. We tested children from Switzerland (N = 38) and Brazil (N = 41). Brazil represented longer mask exposure due to a stricter mandate during COVID-19. Children had to choose a face displaying (...) a specific emotion (happy, angry, or sad) when the face wore either no cover, a facial mask, or sunglasses. The longer hours of mask exposure were associated with better emotion recognition. Controlling for the hours of exposure, children were less likely to recognise emotions in partially hideen faces. Moreover, Brazilian children were more accurate in recognising happy faces than Swiss children. Overall, facial masks may negatively impact children’s emotion recognition. However, prolonged exposure appears to buffer the lack of facial cues from the nose and mouth. In conclusion, restricting facial cues due to masks may impair kindergarten children’s emotion recognition in the short run. However, it may facilitate their broader reading of facial emotional cues in the long run. (shrink)

A notion of delegated causality is introduced here. This subtle kind of causality is dual to interventional causality. Delegated causality elucidates the causal role of dynamical systems at the “edge of chaos”, explicates evident cases of downward causation, and relates emergent phenomena to Gödel’s incompleteness theorem. Apparently rich implications are noticed in biology and Chinese philosophy. The perspective of delegated causality supports cognitive interpretations of self-organization and evolution.

This article aims to make public part of the research on the concept of ‘light’ in the theological and, above all, liturgical tradition of the Greek Orthodox Church, based on its representation of the concept of ‘hypostasis’. Taking as a point of departure the interpretation of the expression ‘light of light’ [φῶς ἐκ φωτός (phôs ek phōtos)] of the text of the Niceno-Constantinopolitan Symbol, the article presents a proposal for the interpretation of the concept of ‘representation’ for this specific case, (...) based on the idea of apomímesis, and applies this concept to a reading of the place of ‘light’ in the Holy Scripture, in the Patrology and in the Greek Eastern Liturgies. El artículo, a partir de la idea de “confluencias” sugerida por Bispo y comentada por Krenak, busca discutir el papel central de las directoras/es de escuelas y otras instituciones para el establecimiento de múltiples “confluencias”: entre estudiantes, entre estudiantes y docentes; entre docentes; entre los responsables de los estudiantes y los docentes; entre todos los funcionarios escolares; entre la comunidad escolar y la comunidad en torno a la escuela; entre la dirección de la escuela y otros niveles de administración escolar; (...) etc. Con el apoyo en las investigaciones con los cotidianos y en las experiencias narradas y comentadas de múltiples acontecimientos, se trabajan tres diferentes ‘_espaciostiempos’_: el tiempo de la pandemia en una escuela infantil; las tensiones y soluciones para las decisiones acerca de la dirección de la escuela en un colegio universitario; la creación de una carrera experimental de formación docente en un municipio diferente a la sede universitaria. Con esas narrativas y análisis se sustenta un estudio más general de los contextos existentes, hoy, que se relacionan con las cuestiones existentes en los ‘_espaciostiempos’ _educativos. (shrink)

Surgiram assim interpretações, quadros, configurações e reconfigurações, ângulos de análise diversificados que fomentarão, por certo, uma reflexão viva dos leitores. É fundamental — continua a sê-lo — repensar e questionar campos temáticos à luz das análises teóricas e concetuais, (...) mas também dos processos, das dinâmicas, das relações, das potencialidades explicativas da nossa contemporaneidade. É assim que se entende este livro, com muitas contribuições, que vêm propiciar e enriquecer a reflexão sobre Outros Combates pela História. Combates pela História é, como se sabe, o título de um livro famoso de Lucien Febvre dos anos cinquenta. Através de uma recomposição, de novo se deu importância a todas as modalidades da História, mantendo, todavia, o sentido do rigor que era algo perseguido nos «combates pela História». Quer-se, pois, analisar o sentido da História, nas suas várias áreas. Contudo, ao propor-se este tema, não se desejou que os autores apresentassem tanto as suas investigações nas suas áreas próprias — embora elas estivessem subentendidas e devessem ser expressas —, mas que refletissem sobre o seu sentido no âmbito da História entendida como Ciência Social e Humana. Para tal, desejou-se que discutissem o objeto e o método da História das diversas áreas, equacionando os seus vários problemas. Foi isso que também sucedeu — estamos disso convencidos. A very influential idea on the nature of normative reasons is that the existence of normative reasons for action depends on the motivational capacity of the agents whose reasons they are: there are reasons for an agent to act only if she has the capacity to be moved to act for those reasons. Many theories of reasons developed in recent years imply at least some version of that idea, and many find it attractive since it incorporates some widespread assumptions about (...) the role of reasons. In this paper, I argue that that idea, understood in any of its prominent readings, is ultimately false. First, I endorse the claim that there is at least one case that shows the possibility of the so-called ‘elusive reasons', that is, roughly, reasons whose existence depends on the agent’s ignorance of the facts that constitute them. Then, I argue that all the crucial objections recently elaborated to the possibility of elusive reasons ultimately fail. The upshot is that we should not aim to explain the nature of normative reasons in terms of motivational capacities of the agents whose reasons they are. (shrink)

The authors explain how rapidly changing demographics and family structure in the United States have greatly complicated the project of top-down government efforts to achieve an "ideal" racial balance in schools. It describes how social capital—a positive outcome of social interaction between and among parents, children, and teachers—creates strong bonds that lead to high academic achievement.

Is Economics an ‘objective’ or ‘positive’ science, independent of ethical and political positions? The financial crisis that began in 2007 gave rise to renewed doubts regarding the ‘objectivity’ of economics and brought into the public arena a debate that was previously confined to academia. A remarkable feature of the public debate on the value neutrality of economics since then was that it not only involved indictments of ideological biases in economic theory, but also the attribution of the crisis itself to (...) the unethical orientation of economic agents, of economists acting as experts and of ‘economic science’ itself. The contributors to this volume believe that economists of all persuasions are once again compelled to probe the normative foundations of their discipline and give a public account of their doubts and conclusions. Predatory pricing is one of the forms of the abuse of a dominant position. Judicial institutions of the European Union and Commission during analysis of predatory pricing devote main attention to the relationship between costs and prices of the dominant undertaking. Moreover, attention is paid also to various cost benchmarks: average variable costs, average avoidable costs, average total costs and long run average incremental costs. European judicial institutions should pay less attention to the costs of a dominant undertaking than to (...) evaluation of the effect of the actions of a dominant undertaking to consumers and competition in the market. Moreover, proposition of the Commission to use average avoidable costs in predation cases does not correspond to the practice of the Court of Justice and the General Court. The Commission should stipulate more clearly how average avoidable costs and long-run average incremental costs should be calculated in order to increase legal certainty of the undertakings. Establishment of prices higher than average total costs by the dominant undertaking should not be recognized as predatory pricing. (shrink)

Abuse of a dominant position is one of the key aspects in EC competition law. The Court of Justice and General Court acknowledge that sometimes the actions of dominant undertaking that might be recognized as abusive should not be prohibited on the basis of Article 102 TFEU, if undertaking provides objective justification or proves that its actions generate positive effect which outweighs negative outcome on competition. Therefore, actions that usually are regarded as predatory pricing, which is one of the forms (...) of the abuse of a dominant position, in case of special circumstances might be recognized as legitimate. In the present case, attention should be devoted to objective justifications, since this provides the basis for evaluation of legitimate, pro-competitive reasons that explain why undertakings may establish prices lower than costs. This article is devoted to the analysis of objective justification, which might prove that allegedly abusive behaviour is actually legitimate. Plenty of factors might be recognized as objective justifications, therefore it is quite difficult to provide a finite list of justifications. (shrink)

One of the most important principles of the European Community law is the prohibition of the abuse of a dominant position based on Article 82 of the EC Treaty. Predatory pricing is one of the forms of the abuse of a dominant position. It is likely that the world financial and economic crisis will lead to an increase in competition among the undertakings. The fact that some dominant undertakings seeking to sustain or increase their market share might decide to engage (...) in predatory pricing and that no comprehensive research on predatory pricing has been carried out by legal scholars in Lithuania and the European Union up to date, underlines the relevance of this study. To decide whether dominant undertaking has become a “predator”, it is necessary to evaluate several issues, such as the ability of the dominant undertaking to recoup its losses incurred during the alleged application of predatory pricing strategy. The judicial institutions of the European Union pay little attention to this issue and might recognize that predatory pricing took place even without the evidence on the possibility for the undertaking to recoup its predatory losses. This study analyses the recovery of predatory losses by the dominant undertaking and the importance of such recovery in determining whether or not the dominant undertaking engaged in predatory pricing. The aim of this article is to analyse different goals of the competition law, which are established in European Union and Lithuania. EU Commission and the Court of Justice distinguish a number of goals of the competition law. Most commonly, mentioned goals of competition law are the following: the integration of the Internal Market, the protection of consumers, protection of the competitors, freedom of competition and economic efficiency. Different goals of competition law are analysed in this paper and relationship between (...) them is explained. Special attention is given to the analysis of protection of the consumers as one of the main objectives of competition law. While analysing protection of the consumers in competition law, a difference between the concept of consumer in competition law and consumer protection law is explained. The authors express a number of critical thoughts towards practice of the EU Commission and the Court of Justice so far, as there is a lack of consistency in evaluation of the protection of consumers’ rights in the context of the other objectives of competition law. Relevance of the present article is supported by the several facts such as revision of the competition law goals by the EU Commission and adoption of resolution “Concerning priority of the activities of the Lithuanian Competition Council” by the Lithuanian Competition Council that establishes main principles (priorities) applied while implementing competition policy in Lithuania. Setting out the main goals in Lithuanian competition law may have important practical consequences in the everyday activities of the Lithuanian national competition authority. (shrink)

One of the most important principles of EC law is the prohibition of the abuse of dominant positions as established in Article 102 TFEU. Predatory pricing is one of the forms of abuse of a dominant position. In order to decide whether the dominant undertaking has referred to predatory pricing it is necessary to evaluate several elements, one of which is analysis of the intent of the undertaking. European judicial institutions and Commission while assessing predatory pricing give too much importance (...) to the intent of the dominant undertaking. It should be recognized that intention to use predatory pricing is only additional evidence for the determination to undertake an abused dominant position. Intent to eliminate competitors and to take a big part in the market is the aim of all dominant undertakings, the driving force of competition. Competition law officers should inquire whether pricing will cause elimination of competitors and damage to consumers. If competition law officers will provide too much importance to consideration of intent in that case competition law rules will be applied to strict and dominant undertakings and will not charge low prices that are good for consumers. Perceptual experience and visual imagination both offer a first-person perspective on visible objects. But these perspectives are strikingly different. For it is distinctive of ordinary perceptual intentionality that objects seem to be present to the perceiver. I term this phenomenal property of experience ‘presence’. This paper introduces a positive definition of presence. Dokic and Martin (2017) argue that presence is not a genuine property of perceptual experience, appealing to empirical research on derealisation disorders, Parkinson’s disease, virtual reality and hallucination. Neste artigo eu defendo que o conhecimento de proposições filosóficas pode e deve desempenhar o papel de ideal regulador das aulas de Filosofia no Ensino Médio. Grosso modo, penso haver dois tipos de conhecimento pressupostos nas aulas de Filosofia no Ensino Médio: o primeiro, que, por conveniência, chamarei de conhecimento filosófico disposicional, e o segundo, o conhecimento filosófico proposicional. O primeiro consiste naquele conhecimento que leva em conta apenas certas habilidades filosóficas de identificação de teses, de identificação e análise de (...) argumentos etc. O segundo envolve a garantia da verdade de uma proposição filosófica via justificação. Argumento que o conhecimento filosófico disposicional, embora seja um pressuposto epistemológico suficiente a ser tomado para a confecção de uma aula de Filosofia no Ensino Médio, não é necessário. Isso porque esse tipo de conhecimento não desempenha satisfatoriamente a função de objetivo último das aulas de Filosofia, se considerarmos uma característica fundamental da Filosofia: qual seja, aquela atividade que, através de seus autores, possui enquanto objetivo último obter conhecimento de certas proposições filosóficas. Além disso, argumento que o primeiro tipo de conhecimento é adequadamente desenvolvido somente se regulado por um ideal de conhecimento do segundo tipo. Assim considerado, além de fazermos, de fato, a Filosofia presente na sala de aula, tendemos a ter ganhos consideráveis para a postura dos alunos frente às questões filosóficas fundamentais. Recent literature on skepticism has raised a nearly univocal voice in condemning skeptical argumentation on the grounds that such argumentation necessarily involves our adopting some nonordinary or unnatural perspective. Were this really so, then skeptical conclusions would not speak to us in the way in which skeptics think they do: We would be "insulated" from any such conclusions. I argue that skeptical argumentation need not rely on any nonordinary or unnatural standards. Rather, the skeptic's procedure is to offer a critique (...) from within. Having given my argument for this claim (which I call the 'continuity argument'), I consider and respond to two important objections. I conclude that the skeptic has a powerful meta-argument to be deployed in defending the legitimacy of his skeptical conclusions against the slings and arrows of (those I call) the half-true theorists. This paper argues that the idea of inclusion is linked to the democratic tradition rather than to the republican one. By analyzing the origins and meaning of these two concepts, the author holds that democracy is rather linked to desire and republic to will (and to the expression of desire), and concludes that, since North Atlantic political tradition has not given a key role to desire, democracy, in order to overcome the difficulties it has been encountering in all parts of (...) the world, should take more account of desire and of the social struggles it brings to the fore. Interest is one of the main sociological and legal categories, which help to discover relation between objective external tendencies and activities of a man. A witness who has procedural rights and obligations is allowed to protect these rights and obligations respectively and thus a witness begins to have an interest in criminal procedure. Two types of interests of witness could be accordingly distinguished, i.e. personal interest and legal interest. The analysis of witness’s interest in criminal cases allows to affirm that (...) the procedural interests of a witness in criminal procedure may be divided into those related to the outcome of the case and those related to a person’s legal position in a definite criminal suit. This article refers to the analysis of types of entrapment while gathering evidence in criminal proceedings. Based on the analysis of the laws of criminal procedure, theory and judicial practice, one could say that entrapment, as absolutely impermissible action in the course of simulation of a criminal act, could not be seen as mere pressure, active enticement or instigation to engage in criminal activity by restricting a person’s freedom of choice. As it happens, it is possible to provoke a person (...) without any active enticement or instigation to engage in criminal activity. This could be regarded as passive, indirect type of entrapment. The gist of the latter – creating the effect of minimum risk, meaning that a person, without any active enticement or instigation to engage in criminal activity, is acting in the course of a simulated situation, by thinking that the criminal activity he or she is committing will never be discovered by law enforcement authorities. The identification of passive entrapment is quite complicated, as it requires the precise assessment of the relation between the conduct of law enforcement authorities, the criminal and the criminal act, by using subjective and objective criteria. The paper deals with certain aspects of the interpretation and application of the law pertaining to the European Arrest Warrant (EAW), which are related to a person’s right to question the possibility of criminal prosecution as well as to the impossibility of execution of criminal prosecution in respect of a person who was not surrendered to the Republic of Lithuania. It is observed that the procedures of the execution of the EAW in legal practice, as distinct from their delineation in (...) the provisions of the legal acts of the European Union, are being inadmissibly misinterpreted in the national law. It conditions infringements of the right of a person to be brought to criminal account to know what he/she is suspected of. A person’s right to question the possibility and the limits of criminal prosecution is a constitutional guarantee towards the legitimacy of criminal proceedings. (shrink)

This article analyzes the issues of content and scope of the immunity of a close person as a witness in criminal procedure of Lithuania. The question on sufficiency of this immunity is raised because protection of a personal and family secret in criminal proceedings depends upon it. The author also perceives uncertainty of the actual and legal status of a close person as a family member, while ascertaining and implementing one of the most important additional guarantees granted for witnesses. The (...) following propositions are formulated: as regards witness’ immunity from obligation to testify against a member of his/her family or against his/her close relative, it is necessary to assess not only the formal aspects of the concepts “family” or “marriage”, but also the actual nature of the relations of persons who are bound by family or similar ties. The article deals with the discussion of the concept and implementation of immunities of the witness in the criminal proceedings in abstracto. The problem is whether the additional guarantee of protection of the witness’ procedural interests, which is fixed in the Law of the Criminal Procedure, is appropriately methodologically regulated, or whether certain immunities of the witness are appropriately perceived and applied in practice, is raised in the present article. Through this reason, the author, searching for the answers to these (...) questions—how is all this and how must all this be?—singles out, in abstracto, two elements of immunities of the witness, in concreto—the immunities of the witness and witnessing. It would seem that these protective guarantees are similar in principle. The analysis of this article allows for the answer that they are analogous from the point of view of their value. However, they differ by the mechanisms of implementation. According to the author, the immunity of the witness protects the person from becoming a witness, whereas the immunity of witnessing secures protection from witnessing, which may cause harm to the witness himself/herself. Accordingly, it also determines the need not only to analyze these two elements, but their interrelation and interrelations as well. (shrink)

The article deals with a discussion of the concept and implementation of the procedure within a reasonable time as a legal principle. The main purpose of the article is to reveal the content and functioning of this principle. The author presents new insights into this principle. From time to time this legal ground evolves into new forms or the criteria, on which it depends, changes; therefore, such issues have to be taken as the basis for evaluating this principle. The following (...) conclusion is drawn in the article: the effect of the principle of the procedure within a reasonable time is not only tied to the obvious suspicion or indictment, but also to any reasonable assumption about the probable prosecution due to various actions carried out by criminal procedure officers under the Code of Criminal Procedure. After summing up the arguments, the author concludes that it is important to estimate the procedural interest of the suspect, defendant or sentenced person. (shrink)
